    Not really a near collision.

    Both boats were sailing as "close to the wind" as possible on their way to the weather mark that is "up wind" on the course. The boat in the foreground had the right away as they were on Starboard tack. The other boat knew it and stayed on Port tack as long as they could rather that loose position and drop in behind the favored boat and sail through the dirty are that was swirling behind it. Both skippers knew exactly what was going to happen.

    If the Port boat had turned too late and forced the Starboard boat to alter course to avoid a collision, they would have had to serve a penalty

    Now IF someone had made a mistake... well that is a whole different situation.

    I used to race my Hobie 16 in Ohio and Indiana. But that was before I got married, had kids and had to work for a living.

    Have also had it to John Pennekamp State Park, KeyWest and Lake Cumberland in Kentucky. All my friends had power boats for skiing, Pulled a skier with it in Cumberland. Still have it out in the backyard. Have not had it out for... I am ashamed to say how long.

    Watched Hobie's racing on the Columbia R. one summer, while windsurfing at Hood River. Sailing was big fun for 20 years, until knees wore out... miss it.

    Sailed Big Boat series in the Bay Area 6 times. Always fun with 15 boats from 45' to 60' shooting for the line.

    Might take more analysis, but it looks like the filming boat (starboard tack) adjusted course slightly to prevent collision. Notice the boat speed slowed and the angle to shore changed.

    I would say grounds for protest and the tacking boat realized it because they bore way off. The penalty is normally disqualification unless the offending boat does a 360 or 720, depending on which rules are used in the race.
