The boat on the right of the frame was on Starboard Tack, they HAD the right of way over the boat on the left of the frame which is on Port Tack. It appears to me the Port Tack boat was giving right of way by heading to pass to the stern of the Starboard boat.

HOWEVER, I believe the Starboard boat gave up their rights by tacking in front of the Port Tack boat. Very costly maneuver for all involved. Possibly deadly.

Just saw this. I agree. the tacking boat was not officially on starboard tack because the mainsail was not full yet. Tacking boats have no rights.
